Welcome to RoomAI. These Terms of Service ("Terms") govern your use of the RoomAI mobile application and website (collectively, the "Service") operated by cuneytemir.com ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, downloading the app, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Informativa sulla Privacy.

1.1 Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

1.2 Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or by email at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Account Registration and Security

To use RoomAI, you must create an account using Apple Sign In or Google Sign In. No email/password registration is available. You are responsible for maintaining the security of your account.

2.1 Account Credentials

You are responsible for all activity that occurs under your account. You must not share your account credentials or allow others to access your account. Notify us immediately at support@cuneytemir.com if you suspect unauthorized access.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

2.3 Account Termination

You may delete your account at any time from Settings > Account > Delete Account. Account deletion is permanent and cannot be undone. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service.

3. The Service

RoomAI is an AI-powered interior design application that allows you to photograph rooms and use artificial intelligence to redesign spaces, visualize new furniture, remove or replace objects, and create design variations.

3.1 Service Description

The Service includes the following core features: room redesign in multiple design styles, furniture placement visualization, object removal and replacement, automatic room decoration, color and atmosphere changes, and AI prompt-based design generation. All AI processing is performed through our secure backend servers.

4. Subscriptions and Billing

RoomAI offers both free and paid subscription plans, as well as one-time credit pack purchases. All paid transactions are processed through the Apple App Store or Google Play Store.

4.1 Free Tier

New users receive 5 free credits upon registration. Free credits are one-time only and do not renew. Free tier designs include a RoomAI watermark and are limited to 1K resolution output. Design history on the free tier is retained for 7 days.

4.2 Subscription Plans

Paid subscription plans provide monthly credit allocations and premium features:

  • Starter ($4.99/month): 20 credits per month, all features, no watermark, 2K resolution, 5 HD upscales per day
  • Pro ($9.99/month): 50 credits per month, all features, no watermark, 4K resolution, 5 HD upscales per day, commercial use license
  • Unlimited ($19.99/month): 150 credits per month, all features, no watermark, 4K resolution, 5 HD upscales per day, priority processing, priority support

4.2.1 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Subscription fees are billed through your Apple ID or Google Play account. Prices are displayed in your local currency and may vary by region.

4.2.2 Cancellation

You may cancel your subscription at any time through your device's subscription management settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.

4.2.3 Credit Rollover

Unused subscription credits do not roll over to the next billing cycle. Credits reset to your plan's monthly allocation at each renewal. One-time credit pack purchases never expire and are not affected by subscription changes.

5. Credits System

RoomAI uses a credit-based system for AI design generation. Understanding how credits work is important.

5.1 Credit Costs

Each AI design generation (redesign, furniture placement, object removal, replacement, auto decorate, color change, atmosphere change, or AI prompt mode) costs 2 credits. HD upscale costs 1 credit for non-subscribers, while subscribers receive 5 free HD upscales per day.

5.2 Credit Refunds

If an AI generation fails due to a system error, the credits for that generation are automatically refunded to your account. No action is required on your part.

5.3 Credit Packs

One-time credit packs are non-refundable in-app purchases. Credits from packs never expire and remain available until used, even if you cancel your subscription. Available packs: 10 credits ($2.99), 35 credits ($7.99), 100 credits ($19.99), and 300 credits ($49.99).

6. AI-Generated Content

RoomAI uses artificial intelligence to generate interior design images based on your inputs. This section governs the ownership and use of AI-generated content.

6.1 Ownership of Generated Content

Subject to these Terms, you retain rights to AI-generated images created through your use of the Service. You are granted a worldwide, non-exclusive license to use, reproduce, modify, and distribute your generated designs for personal and, where your subscription plan permits, commercial purposes.

6.2 Commercial Use License

Commercial use of AI-generated designs (such as in client presentations, marketing materials, or real estate listings) is permitted only on Pro and Unlimited subscription plans. Free and Starter plan users are limited to personal, non-commercial use.

6.3 AI Output Limitations

AI-generated designs are intended for visualization and inspiration purposes. Results are not architectural plans and should not be used as construction documents. RoomAI makes no guarantees about the accuracy, feasibility, or safety of implementing any AI-suggested design changes. Always consult a qualified professional before making structural modifications.

6.4 No Guarantee of Uniqueness

Due to the nature of AI generation, similar inputs may produce similar outputs for different users. We do not guarantee that AI-generated content will be unique to your account.

7. User Content

This section covers the photos and other content you upload to the Service.

7.1 Your Ownership

You retain full ownership of the original photos you upload to the Service. We do not claim any ownership rights over your uploaded content.

7.2 License to Process

By uploading photos, you grant RoomAI a limited, non-exclusive, royalty-free license to process, store, and transmit those images solely for the purpose of providing the Service (generating your requested designs, displaying your design history, and enabling sharing features). This license terminates when you delete the content or your account.

7.3 Content Responsibility

You are solely responsible for the content you upload. You represent and warrant that you have the right to upload and use any photos submitted to the Service, and that your content does not infringe on the intellectual property rights of any third party.

8. Acceptable Use

You agree not to use the Service for any of the following prohibited purposes:

8.1 Content Restrictions

  • Generate, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Upload photos containing identifiable persons without their consent
  • Generate content that infringes on intellectual property rights of third parties
  • Attempt to generate content that is sexually explicit, violent, or depicts illegal activities
  • Use the Service to create deceptive or misleading real estate listings

8.2 Technical Restrictions

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Attempt to bypass credit limitations, rate limits, or security measures
  • Use automated scripts, bots, or scrapers to interact with the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Access the Service through unauthorized means or share API keys
  • Create multiple accounts to abuse free credit offers

8.3 Resale and Redistribution

  • Resell, sublicense, or redistribute RoomAI as a service to third parties
  • Use the Service to build a competing product or service
  • Bulk generate designs for resale without a commercial license

9. Intellectual Property

9.1 RoomAI Ownership

The Service, including its design, code, AI models, AI prompt templates, branding, logos, and all associated intellectual property, is owned by cuneytemir.com and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you.

9.2 Trademarks

"RoomAI" and associated logos are trademarks of cuneytemir.com. You may not use our trademarks without prior written permission, except as reasonably necessary to identify the Service as the source of AI-generated content (e.g., the RoomAI watermark on free-tier designs).

9.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into our products without any obligation or compensation to you.

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 No Professional Design Advice

RoomAI is a visualization and inspiration tool, not a substitute for professional interior design, architectural, or structural engineering advice. AI-generated designs may not account for building codes, structural limitations, electrical layouts, plumbing, or other practical considerations. Always consult qualified professionals before making modifications to your home.

10.3 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. AI generation times may vary, and the Service may be temporarily unavailable for maintenance or updates.

11. Limitation of Liability

11.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROOMAI OR CUNEYTEMIR.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

11.2 Maximum Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless RoomAI, cuneytemir.com, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Service or violation of these Terms
  • Content you upload, generate, or distribute through the Service
  • Your violation of any rights of another person or entity
  • Your violation of any applicable law or regulation

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which cuneytemir.com operates, without regard to conflict of law principles.

13.2 Informal Resolution

Before initiating formal dispute resolution, you agree to first contact us at support@cuneytemir.com and attempt to resolve the dispute informally for at least 30 days.

13.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted in English.

13.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.

14. Account Termination

14.1 Termination by You

You may terminate your account at any time by deleting it through Settings > Account > Delete Account. Termination does not entitle you to a refund of any prepaid subscription fees or unused credits.

14.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

  • You breach any provision of these Terms
  • You engage in fraudulent or abusive behavior
  • We are required to do so by law or regulatory authority
  • We discontinue the Service (with reasonable notice to active subscribers)

14.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your account data in accordance with our Privacy Policy. Provisions that by their nature should survive termination will remain in effect, including ownership, liability limitations, and indemnification.

15. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by email at least 30 days before they take effect. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the Service after changes become effective constitutes acceptance.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will continue in full force and effect.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and cuneytemir.com regarding the Service and supersede all prior agreements and understandings.

17.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any provision will only be effective if made in writing and signed by an authorized representative.

17.3 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17.4 Force Majeure

RoomAI shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet service disruptions.
